Extract from the article:

The Supreme Court has made a significant ruling stating that demolishing properties of individuals accused or convicted of crimes without due process violates constitutional rights and amounts to "bulldozer justice."

The court highlighted the importance of shelter as a fundamental right and emphasized that only courts have the authority to impose punishments.

Moreover, government officials found responsible for illegal demolitions will face personal liability for restitution and damages.

This landmark judgment underscores the need for upholding the rule of law and protecting the rights of all individuals, irrespective of their legal status.

My Take:

Double Standards  16 June 2014

In my above mentioned blog ," I discussed a case where residents of Campa-Cola building in Mumbai faced eviction and demolition of their homes due to the alleged illegal construction.

The Supreme Court's recent ruling on unauthorized demolitions resonates with the injustice highlighted in that blog.

The scenario underscores the importance of fair treatment and due process, echoing the sentiment that the law should protect the innocent while holding the guilty accountable.

Maharashtra’s policy for dilapidated buildings .. 18 July 2019

In another blog post focusing on Maharashtra's policy for dilapidated buildings, I touched upon the concept of holding building owners accountable for neglecting maintenance.

The current Supreme Court ruling aligns with the idea of enforcing responsibility, this time shifting the focus to government officials and their actions.

Just as the Maharashtra policy looked to recover costs through auctioning properties, the court's directive on personal liability for officials involved in illegal demolitions signifies a step towards ensuring accountability and justice.

Call to Action:

To the government officials and authorities involved in executing demolitions, I urge you to adhere strictly to legal processes and respect the rights of all individuals, even when enforcing justice.

Upholding the law while safeguarding fundamental rights is crucial for a fair and just society.

Let's work together to ensure that justice is served within the bounds of the constitution and uphold the principles of due process and accountability.
