24x7 e-Courts ?

 


 

That is the only way to reduce :

Ø  pending court cases from 3 crore to 3 lakhs

Ø  ave pendency from 8 years to 8 weeks


Thank You, Supreme Court for moving towards this goal, as reported in :

E-courts may let cases be filed 24/7 from anywhere

Ø  Limiting the registry’s role in prioritising cases, Phase 3 of the e-Courts project, currently in the draft stage, has   proposed a 24/7 digital window to litigants and lawyers to filecases from anywhere, anytime with the provision of scheduling   digital hearings in an  open court , ensuring  compliance  of  timelines  by both judges  and litigants.

 

Ø  Use of  artificial  intelligence  has  been  proposed  to  “intelligently  recommend  schedules  for  hearing  by  optimising  and coordinating the schedules and time of different actors ( judges, lawyers and litigants)”, the draft proposal put up on the website of the justice department seeking stakeholders’ suggestions said.

 

 

Ø  At a cost of Rs 2300 crore, it has computerised almost  all  19,000  functional  district  and  subordinate  courts  with  broadband  connectivity  and  equipped  judges and courtrooms with modern communication gadgets.

 

Ø  The next phase of judicial reforms envisages a complete transformation of Indian courts into digital platforms — having facilities of,

       #    e-Pay,

       #   e-Summons,

      #   e-Hearings

      #   e-Judgment ,

Justice Bobde said : 

We are not going to let the use of AI spill over to decision making. It will fully retain the autonomy and discretion of judges to decide cases, though at a much faster pace at which the readiness of information is made available by AI

I believe that an Artificial Intelligence System that decides the case, could be disastrous to judiciary.. It is not designed to take a decision but only to provide information asked "

-           Where,

     #   litigants can appear remotely,

    #   schedule hearings at his / her convenience,  and

    #   an option of choosing alternative dispute resolution mechanism or a

         regular case while e-Filing.


Ø  It has proposed an interoperable criminal justice system where connectivity between courts, prison and police will be leveraged to ensure speedy trial of cases and limiting adjournments on account of non-appearance of witnesses or unavailability of lawyers.

 

Ø  The digital court will provide for a data exchange protocol embedded with a privacy policy.

 

 Ø  During the second phase of the e-Courts project, more than 3,400 courts were made videoconference compatible, providing connectivity with prisons

These facilities are already available in the Supreme Court and HCs

 

 Ø  The court registry will be converted into a digital case registry where each case will be given a unique number that will help in locating the case as it moves from one level to another, without the need of refiling of documents in case of appeal in higher courts.

             MONTHS , we must do better than the Chinese – as follows :

          #   Method of conducting “ Online Trial “ ( Audio – Video Conference calls )

         #   Who can “ watch “ the online trial and how ( Video broadcast ) and when


         #   Progress Chart as trial proceeds / Upload – Download of documents


        #   Court Room allotted ( by software ) to each litigation


             Not being limited by any “ Physical Constraints “ , it will be possible ( for

             the software ), to open as many “ Virtual / Online “ Court Rooms as

             required

            

            Only limitation will be the Number of available Judges at any given time

 

           Let none have doubts about the ability of our Start Ups to design / develop

           and launch such a portal within 6 months , whose “ Conceptual Frame

          Work “ could resemble ,

           

           On Line Jobs Fair   


           Software Architecture For Online Jobs Fair   


        And as far as finding 10,000 Judges to conduct “ Online Trialsfrom the

        comfort of their homes ( and  without imposing any “Infrastructure Burden“

        on State except providing them with a fast broadband connection ), I

        suggest that we rope in retired judges on a “ Per Case Retainer “ basis (

        paid into their Jan Dhan accounts )

             

                        

       There must be a “ Bonus cum Penalty “ formula to govern the payments to

       the Judges , depending upon the “ Actual Time “ taken to dispose off a

       given case as against the “Target Time “ ( to be computed

       by Artificial Intelligent Software, based on historical data being continuously

       compiled for all the cases, once the portal gets launched )

           

               

     I urge Chief Justice Hon Deepak Misraji to treat this email as a PIL and “

    direct “ the NDA government to initiate action on this suggestion ( I cannot

    afford a lawyer ! )
