Maharashtra gets its first virtual court to handle traffic challan cases   [  02 Nov 2020 ]

Extract :

Ø  A dedicated virtual court for traffic violations in Maharashtra has been inaugurated by Chief Justice of India S A Bobde, an initiative aimed at freeing up judicial officers in every district from the burden of routine cases involving challans

Ø  “ Cases from across Maharashtra will be filed in this virtual court electronically “, said Justice Dhananjay Chandrachud.  “ A single judge sitting in Katol will adjudicate all the cases electronically . Violators can plead guilty and pay the fine by visiting www.vcourts.gov.in , or choose the option to contest the case “

 

Ø  “ Implementation of the virtual court concept has freed 19 judicial officers who now can handle litigation instead of taking up routine traffic violation cases “, Justice Chandrachud told TOI

Justice Chandrachud said the E-Committee could assign the task of running the virtual court to ANY judicial officer in Maharashtra. The task of compounding the offence on payment of fine can be performed from ANYWHERE in the State as all work is done electronically by virtual mode , he added

Average e-transactions for 304 days this year was Rs 66.56 lakh per day

Ø  The Supreme Court on Tuesday favoured serving court summons through SMSWhatsApp and email in contrast to the present system of physical delivery to the accused and sought response from high courts and state DGPs on adopting such digital means.


>  A bench of Chief Justice S A Bobde and L Nageswara Rao, which is

    examining various measures to remove deficiencies in criminal trial and to       ensure expeditious trial in criminal cases, directed the high courts and DGPs     to give suggestions within four weeks on a report of senior advocate                 Siddharth Luthra and lawyer K Parameshwar, who as amicus curiae,                 recommended serving summons through digital platforms in case of bounced      cheques.

     

 " The high courts must also be directed to formulate a scheme for online mediation of pending cases at the trial / appeal / revisional stages so that pending case could be effectively disposed off “

Ø  Embracing technology keeps us in tune with the times. Since the virus outbreak, this view has gathered further relevance. India has about 448 million mobile phone internet users according to statista.com. The apex court’s move will lessen physical contact in delivery of summons and increase quicker public outreach in many cases.

         cannot be done . 


         What kind of a trial is this ? Is this a kind of joke ? “

If we want to reduce the average “case disposal time “ from 6 YEARS to 6 MONTHS , we must do better than the Chinese – as follows :

Ø  Launch online portal……..www.OnlineJustice.gov.in

                   …..having following features / pages / User Interfaces :

            #   Who can register a litigation and how ( detailed form to be filled in )

            #   What kind of complaints can be filed ( Eg; property / divorce / fraud 

                  / loans etc )

           #   Time frame of hearings ( based on backlog at that point )

           #   Search / Selection of “ empanelled lawyers “ ( with their fees tariff )

           #   Method of conducting “ Online Trial “ ( Audio – Video Conference calls )

           #   Online payment of Court Fees / Lawyer’s fees

           #   Who can “ watch “ the online trial and how ( Video broadcast ) and

                 when

           #   Progress Chart as trial proceeds / Upload – Download of documents

           #   Court Room allotted ( by software ) to each litigation

 

Not being limited by any “ Physical Constraints “ , it will be possible ( for the software ), to open as many “ Virtual / Online “ Court Rooms as required


     Only limitation will be the Number of available Judges at any given time

    Let none have doubts about the ability of our Start Ups to design / develop and

    launch such a portal within 6 months, whose “ Conceptual Frame Work “ could 

    resemble ,

     

     On Line Jobs Fair   

    

 And as far as finding 10,000 Judges to conduct “ Online Trials “ from the comfort

 of their homes ( and without  imposing any “ Infrastructure Burden “ on the State

 – except providing them with a fast broadband connection),

   

I suggest that we rope in retired judges on a “ Per Case Retainer “ basis ( paid into their Jan Dhan accounts )

        

There must be a “ Bonus cum Penalty “ formula to govern the payments to the Judges , depending upon the “ Actual Time “ taken to dispose off a given case as against the “ Target Time “ ( to be computed by Artificial Intelligent Software, based on historical data being continuously compiled for all the cases, once the portal gets launched )

                

 I urge Chief Justice Hon Deepak Misraji to treat this email as a PIL and “ direct “ the NDA government to initiate  action on this suggestion ( I cannot afford a lawyer ! )

Your " Activism " in this matter will go a long way to restore the faith of the ordinary citizens in the judiciary  !
