Context :

Data Protection Bill To Be Finally Tabled In Parliament This Month  /  Inc42 / 07 Jan


Extract :

Ø  The final draft of the bill will include 89 amendments and one new clause, the head of the committee dealing with the draft announced.

Ø  Lekhi also said that the 30-member committee extensively debated all aspects of the bill and reached a “consensus” across different party lines.

Ø  Earlier, certain members of the committee had raised concerns around the government’s power to access citizen data without consent. “Clause 35 of the bill facilitates the government powers of surveillance. The parameters mentioned in the provisions are not clear in their implications. The use of phrases such as “security of the state” and “public order” in the provisions indicates ambiguity in terms of its applications,” one public-policy researcher Kazim Rizvi had previously noted.

Ø  Besides this, they also highlighted issues with the inclusion of non-personal data in the new law and the absence of judicial participation in selecting the head of the regulatory body. Some members also questions whether data should be localised.

Ø  The committee started discussions on the bill on January 16 last year and has conducted over 66 sittings since then, with close to 160 hours being spent on the deliberation. It has also received about 800 representations from a cross-section of stakeholders including industry, lawyers, associations, non-profits and public representatives.

Ø  Lekhi, in a subsequent statement, said, “Whosoever is required, whether an individual or an entity, will be asked to depose before the panel on the issue of protection of data and its privacy and their respective social media platforms will be thoroughly examined by the panel. It would be inappropriate and unfair to look at the calling of social media platforms from a political prism.”

Question  :

Will the Social Media render the Data Protection Bill, infructuous even before it is passed by Lok Sabha ?


Why do I feel this way ?

It seems Social Media are fast coming up with new tricks to use Personal Data of users without their permission ( and make a ton of money, without compensating the users ) . Here is proof :


WhatsApp tweaks privacy policy to share more user data with Facebook    /   Adgully – 07 Jan 2020

Extract :

WhatsApp updated their privacy policy on Monday that allows the messaging app to share commercial user data with parent company Facebook, as the company aims to enhance business usage among group companies.

The revised privacy norms allow the sharing of business interactions across the group. Those who do not accept the updated privacy policy which come into force in February will not be able to access their chats on the messaging platform.

Critics of the move have said the updated privacy policy allows the company to monetize private data of the user without their consent and share this data with businesses and third party providers that transact on these platforms

The policy requires users to share transaction data, mobile device information, IP address, and data on how they interact with businesses via Facebook owned platforms.

India has 400 million WhatsApp users and 310 million Facebook users (according to Statista) which makes it the largest user base for the social media network

There is only one way to stay ahead of such “ thievery “ by the Social Media

That way is for introduction of a NEW clause in the Data Protection Bill, titled :

Grant of a Special Power of Attorney by the Users

Under this clause, any user of Social Media can / will , absolutely voluntarily grant to the Government ( or Data Regulator ), a Special Power of Attorney, enabling the Government to enter into contracts with the Social Media on behalf of such users, to get the users compensated for use of their Personal Data by the Social Media

For this purpose, Govt will create an online portal ( www.IndiaDataCustodian.gov.in ) where willing users will ,

Ø  Register

Ø  Submit their Personal Data ( at 10 different levels of personal data details )

Ø  Authorize the Government to fix the “ Sale Price “ to the Social Media, for sale of anonymized / aggregatedBulk User Dataat each level ( without revealing user identity in any way )

My suggestion ( to enable Users to monetize their own Personal Data ), is congruent with the Government itself SELLINGpersonal data of its citizen, as can be confirmed from the following news reports / blogs :
