Hi Friends,

Even as I launch this today ( my 80th Birthday ), I realize that there is yet so much to say and do. There is just no time to look back, no time to wonder,"Will anyone read these pages?"

Judicial Wisdom Prevails

Judicial Wisdom Prevails

The recent directive from the Supreme Court, urging authorities to file charges only when there's a reasonable chance of conviction, is a profound move that truly resonates with me. It’s a call for prudence, a plea for thoughtful consideration before action, and a significant step towards reinforcing the integrity of our justice system. This isn't merely about legal technicalities; it's about safeguarding individual dignity, preventing undue harassment, and ensuring that the machinery of law operates with precision and fairness.

Think about the burden placed on an individual when a charge is filed, even if it eventually proves baseless. The mental, financial, and reputational toll can be immense. This directive seeks to alleviate that, demanding a higher threshold of evidence and a more discerning approach from investigators and prosecutors. It underscores that justice isn't just about punishment; it's fundamentally about fairness and protecting the innocent from prolonged agony.

This emphasis on careful assessment before proceeding echoes sentiments I've expressed in other contexts. For instance, in my reflections on the government's push for self-regulation in online content, I highlighted the critical need for a balanced approach that champions free expression while meticulously guarding against misinformation and profit-driven motives Awaiting Govt Action On Monetization of Online Content. I remember discussing with Rajeevji how crucial it was to address the imbalances in content monetization and the pivotal role of tech giants in shaping a fair playing field online. Just as with content regulation, where the aim is to avoid stifling creativity while preventing harm, the judiciary's directive here is about avoiding the pre-emptive branding of individuals as criminals without robust grounds.

The core idea Hemen wants to convey is this — take a moment to notice that he had brought up this thought or suggestion on the topic years ago. He had already predicted this outcome or challenge (if you find any of his writings relevant), and he had even proposed a solution at the time. Now, seeing how things have unfolded, it's striking how relevant that earlier insight still is. Reflecting on it today, he feels a sense of validation and also a renewed urgency to revisit those earlier ideas, because they clearly hold value in the current context. The principle of demanding a "reasonable conviction chance" for legal charges mirrors the need for a "reasonable basis" when regulating online narratives or making significant policy decisions. Both scenarios call for discernment, a weighing of potential harm against the pursuit of a broader good, and a commitment to procedural integrity.

This judicial wisdom, urging restraint and thoroughness, is not just a legal reform; it's a societal one. It encourages us all to pause, reflect, and gather sufficient evidence before making accusations or enacting decisions that could profoundly impact others. It's a lesson in responsibility, not just for the legal fraternity, but for every sphere of public and private life.

Regards,
