CAA : A Home for the Persecuted

 


 

Context :

The 2019 Citizenship (Amendment) Act, or CAA, does not discriminate on the ground of religion but makes a distinction on the grounds of “religious persecution” in countries where Islam is the State religion, the Union government has submitted in the Supreme Court , adding that CAA seeks to undo the “historical injustices” meted out to persecuted minorities in Pakistan, Afghanistan, and Bangladesh.


 “ CAA does not classify or differentiate on the ground of religion rather it classifies on the ground of religious persecution in countries functioning with a State religion.


Arguing that CAA does not approve of citizenship to Tibetan Buddhists from China or Tamil Hindus from Sri Lanka, the government said that the allegation that the law attempts to classify the persons belonging only to the Muslim community as illegal migrants has no basis in law or in fact.


 

 “It is submitted that rather than breaching any principle of freedom of religion, CAA seeks to protect the freedom of religion of the classified communities which have been persecuted for exactly expressing and practicing their respective religions in the particular neighbouring countries,” stressed the affidavit.

 

 Responding to a complaint in the batch of PILs regarding the choice of the countries and the communities sought to be granted citizenship under CAA when religious persecution is prevalent in several other countries as well, the Centre contended that CAA does not seek to provide answers to all kinds of purported persecution across the world

 

 

MY  TAKE :

I am disappointed that this Govt Affidavit, fails to follow the “ amendments “ to CAA, as suggested in my following 3 YEAR old e-mail :

Extract :

 

Short title :

This Act may be called :

 

Religiously Persecuted Foreign Minorities ( grant of Citizenship ) Act, 2020   [  RPFM  ]

 

Amendment of section 2 :

Under this amendment, Indian “ Certification of Naturalization “, may be granted to foreigners who have entered into India, on or before the 31st day of December, 2014, under following criteria :

 

 

[ A ].. Country of Foreigner

 

          Such a foreigner could hail from any country of the world

 

[ B ]… Religion of Foreigner

 

           Such a foreigner could belong to any religious community

 

[ C ]…. Status of Foreigner

 

            In his / her own native country, said foreigner must belong to a religious

            minority, which has been or  currently being , persecuted for his / her

            religious belief

 

            

 

[ D ]…. Proof of persecution

 

           While applying for Indian “ Certification of Naturalization “, under this

           RPFM Act, the foreign person would need to prove to the satisfaction of the

           Home Ministry, that he / she was persecuted by the majority religious

           community in his / her native country before entering India

           

      

 

Foreigners failing to fulfill the conditions for issue of “ Certificate of Naturalization “ :

If an applicant fails to fulfil the conditions laid down for the issue of the “Certificate of Naturalization “, then ,

 

         Ø    He / she will be reimbursed the cost of repatriation to his / her native

               country

 

         Ø    In case of his / her native country refusing to take him / her back, he / she

               may continue to stay in the same city / town of India, where they are

               currently residing, with the status of, “  Atithi of India 

 

          Ø    As an “Atithi “, such person cannot buy / own any property in India but

                may continue to earn their livelihood as at present and pay legal taxes on

                their income as per Income Tax Act

 

                

 

Detention Camps :

Persons failing the conditions for getting “ Certification of Naturalization “, will not

be forced to stay in facilities specifically created for their stay by the Government

 . But , if requested , they will be granted “ Temporary Accommodation “ in such

 facilities

 

Children born to such Foreigners :

If such children are born in India, they will be granted Indian Citizenship, even if

 the foreigner failed to get “Certificate of Naturalization “ 

 


Dear Amitbhai,

 

Today, India is facing a problem of :

“ Migrants persecuted in their Country because they belong to a Religious Minority in their own country “

This ( religious persecution ) is not the main reason why millions from :

Ø  Mid-East and North Africa are flooding the rich European Countries / UK

Ø  South America and Mexico are flooding USA

Ø  Myanmar / Bangladesh are trying to reach Phillipines-Indonesia-Austalia-NewZealand

They are trying to escape POVERTY / UNEMPLOYMENT in their countries

This trend is picking up after the COVID pandemic and UKRAINE war has pushed up inflation in all countries around the world , while simultaneously slowing down economies and rendering millions jobless

Economies of Pakistan , Afghanistan and Bangladesh ( not to mention Sri Lanka ), are deteriorating

Before long, “ Economic Migrants “ from these countries ( to India ), will far exceed the “ Religiously Persecuted Migrants “

And among these, MUSLIMS will be TEN TIMES the HINDUS  !

When that happens, current “ trickle “ will seem like a minor irritant !

What India needs is to start preparing itself for :

 “ How to stop this TSUNAMI of MILLIONS of MUSLIM ECONOMIC MIGRANTS ? “
