Fresher need not apply ?





Most job advts ( online or offline ) , carry this notice


Occasionally, it takes following form :

Ø  Persons without prior experience need not apply ,

  OR

Ø  Minimum Experience required :  2 – 5 – 7 years


When I studied PM –SVANidhi (PM Street Vendors’ Atmanirbhar Nidhi) scheme, I could not escape the feeling that

Ø  You cannot get this loan ( Rs 10,000 ), if you have never been a “ self-employed “ Street Vendor earlier


Conclusion :


Ø  Scheme is meant to help only those who have been “ Self Employed “ through their own means, earlier

Ø  It is NOT designed to help people, who are just entering the JOB MARKET ( 12 million each year ), who cannot find ANY job anywhere , and need a loan to become a self employed street vendor for the first time ( without any PRIOR experience as a Street Vendor )

Does the much touted MUDRA Scheme, help FIRST-TIMERS ( fresher  without any prior Self Employment record ), to get loans ?

Grant a hawking license to all 3 lakh hawkers ( and all want to become “self- employed “), on following terms / conditions / methods :


Ø  Hawkers will declare themselves “Self- Employed”, by registering so on BMC website

              
Ø  BMC will issue to them , a hawking license – a plastic card with, photo, name, gender, birth-date, address, mobile no, Aadhar No, PAN etc .
    Card will be embedded with a pre-paid / rechargeable FasTag , which will
    automatically transfer to BMC’s bank account, LICENSE FEE, as mandated
     

Ø  On the hawker’s Smartphone ( with BlueTooth / NFC / Biometric ), BMC will
    install a Mobile App [ HawkWalk ? ], which can read the FasTag in the plastic card and display ( 24x7 ), exact location of that hawker on a DASHBOARD in the Central Hawking Control Room of BMC 
       

Ø  If a hawker uses mobile payment app BHIM for accepting payments against his
    sale, 5 % of each SALE PROCEED will get automatically credited to his monthly License Fee


Ø  This great incentive will accelerate DIGITAL PAYMENTS and help organize this
     totally “un-organized “business sector

Ø  Since ALL hawkers will become LICENSED, they will stop paying those daily 

HAFTAs to police !

Highlights :

Prime Minister Narendra Modi on Wednesday said efforts are being made to provide an online delivery platform to street food vendors on the lines of big restaurants.

The prime minister also urged the street vendors to adopt the digital payment system on a large scale.

Now customers avoid making payment in cash and pay directly through mobile phone," he said.

Modi told the street vendors that representatives of banks and such organisations will reach out to them, provide the QR code and inform them about its use.

"I appeal to them (street vendors) to use digital payment more and present an example before the world," he said.

He said the government will make efforts to ensure that street vendors in all big cities of the state get benefit of the PM SVANidhi scheme.

The government launched the PM SVANidhi scheme with easy rules so that they can get rid of paying interest on loans which they used to take from private lenders.

If you make digital transaction, you will get rewarded for it and you get more loan next time, he said

Ø  The Centre on Monday launched a 24X7 toll free mental rehabilitation helpline (1800-599-0019) for providing psychological support to people.
Ø  The helpline will offer mental health rehabilitation services with the objective of early screening, first aid, psychological support, distress management, mental wellbeing, promoting positive behaviour and psychological crisis management, the minister said.
Ø   “This toll free helpline will be operational 24 hours a day, seven days a week with the technical coordination of BSNL. It is backed by 660 clinical and rehabilitation psychologists and 668 psychiatrists,” he said.

Ø  The callers will then be connected to mental health experts who will help to resolve the issue or refer and connect to external help (clinical psychologists or rehabilitation psychologists or psychiatrists), the official explained.

Ø  Professional support for the helpline is being provided by the Indian Association of Clinical Psychologists (IACP), Indian Psychiatrists Association (IPA) and Indian Psychiatric Social Workers Association (IPSWA), he added.

Ø  The entire conversation will get recorded ( Video + Audio ) and can be downloaded by the Talker( Patient)  ( but not by the Listener ), if he so desires
   
Ø  Portal will be obliged to make this recording available to a Court of Law, in case of any litigation

Job Portals : morphing as Consent Managers ?





Job Portals have been around for 30 + years – biggest being Naukri – MonsterIndia -TimesJobs  - Shinejobs etc
Each claim to have databases of 20 to 40 million resumes of jobseekers
Main services offered by Job Portals are :
  • To Jobseekers (  FREE service ) :  Submit Resume / Search Jobs and Apply Online or thru a Mobile App
  • To Employer Companies : ( Subscription based ) : Post Job advts / Search and download Resumes ( limited numbers )

Occasionally , some Job Portals offer “ Resume Writing “ service to jobseekers ( for a fee )
At its core, this traditional Business Model is nothing more than :
Selling “ resumes of jobseekers to employers (by charging hefty subscriptions ) and enticing jobseekers to provide their PRIVATE / PERSONAL DATA ( with offer of a FREE service ) “
And, while “ Submitting Resumes “, jobseekers grant an “ omnibus consent “ to the job portal , by clicking on “ I agree with the Terms and Conditions “ ( without reading ). Far from an “ Informed Consent “
I think this Business Model is very likely to undergo a major change, in light of the just released Draft of Government Policy permitting Indian Citizen to “ Sell their PERSONAL DATA “ , as described in my following blog :

I see following possibilities :

[ A ] …. Job Portals may start selling of “ Bulk “ resumes to Companies with no interest in “hiring “any
            candidate but to use the database for targeted advertising, in order to increase customer base ( Eg :
           Educational Institutions / Health-Care Companies / E Commerce Portals / Insurance Companies etc )
            In this scenario , Job Portal starts acting as a CONSENT MANAGER and would require to obtain from
            the Jobseekers concerned, their “ SPECIFIC – INFORMED “ consent

[ B ]…..  Some Start-Ups becoming CONSENT MANAGERS, and facilitating transfer of RESUME-DATABASES
             from one company ( Seller ) to another company ( Buyer )
            It is worth remembering that most organized sector companies ( and especially those who have, in
            the past, subscribed to Job Portals and, over the years downloaded THOUSANDS of resumes for which
            they have no use any more . These resumes are just lying on their servers . So why not unleash their
           intrinsic / latent value by selling ?

Here is my guess for the Data Fields which you might find in a SUBMIT RESUME form of a job-portal :

3.     Photo ( sometimes optional ) 
4.        Mobile  Number  /  Email  ID  /  Birth Date

7.        Current  Employer -  Designation  -  Salary 
8.        Jobs  held  in past – names of Companies – Periods worked – Salaries drawn – Designations held
9.        Reasons for leaving /  Position applying for or interested in

Has there been any Court Judgments in past on the legality ( or otherwise ) of Job Portals " Selling "  personal data of jobseekers to third parties ?

YES . ( source : A  Fool's Paradise ?  / 29 Aug 2017 ) , from which I quote :



"At the time of entering personal information or data, job-seekers are not aware that the said data can be sold to any third person or that it can be misused. Accordingly, the said ostensible consent of the said applicant/individual cannot be said to be a free, voluntary or informed consent..." he said.
 


"It is common knowledge that when a person applies for a job on the internet, s/he feeds personal information which includes name, address and mobile number. In my opinion, the said data being personal information cannot be transferred /shared / sold to some third person without the consent of the said person," the court said.

How do you propose compensating the Jobseekers when Consent Manager " Sells "  his personal data ?

>  Upon receiving a " I want to buy ( shopping cart of shortlisted resumes ) " request , Consent Manager ( Job Portal ),to obtain SPECIFIC / INFORMED consent from each resume-owner who got shortlisted ( may be an email with a link to click, fully explaining the purpose )

>  Asking the BUYER to direct deposit  ( DBT ) , Rs 30 / - in the JanDhan Bank Account of each consenting Resume-Owner

>  Upon getting confirmation of the CREDIT from each JD Account , Job Portal to email resumes of the relevant-consenting jobseekers to the Buyer

Now , you can guess what will happen !
