Begging Bowl Syndrome ?

Private property not outside state purview: Supreme Court

Property held in private hands cannot be said to be outside the State’s control in the interest of sustainable development and intergenerational equity, a nine-judge Constitution bench of the Supreme Court observed on Wednesday, while examining a legal question whether the State can exercise control over privately held property or resources under the term “material resources of the community” in Article 39(b) of the Constitution.

===============================================

My Take :

Way back in1952 , Congress govt had introduced " Estate Duty " , which was payable by the children of a deceased person - essentially, Inheritance Tax ( which Sam Pitroda wants us to debate and for which, there is a clear hint in Congress Manifesto - and in frequent speeches of Rahul Gandhi )

Subsequently this Estate Duty was withdrawn by Manmohan Singh govt in 1985 , saying it only " collected " litigation and all of Rs 20 crores !

A self goal by Congress , which is shouting from roof top that most Electoral Bonds went to BJP and Congress was holding a begging bowl

Now imagine what those BIG industrialists / businessmen - the biggest givers of Electoral Bonds ( no prize for right guess ) must be thinking !

" If I help Congress win in forthcoming election , I will be committing harakiri. I will be signing my own death warrant . My market cap will drop by billions of Rupees . Forget about funding Congress - above the table or below the table .

If Congress wins, it will be my children who will be holding the begging bowl "

Can’t question EVMs solely on suspicion: Supreme Court   ..   HT  … 25 Apr 2024

Extract :

The Supreme Court on Wednesday emphasised that the Election Commission of India (ECI), a separate constitutional authority, is responsible for overseeing election management, adding it cannot issue orders that question the efficacy of Electronic Voting Machines (EVMs) and their integration with the Voter Verified Paper Audit Trails (VVPATs) based solely on suspicions or private reports.

A bench of a bench of justices Sanjiv Khanna and Dipankar Datta added that it cannot do much if the petitioners -- who demanded 100% cross-verification of votes cast on EVMs with VVPATs or going back to the ballot paper system -- were “already prejudiced”.

“We can’t control the elections. We are not the controlling authority of some other constitutional authority. If there are issues, there are laws to deal with them. The judgment of this court (in 2013) directed them to use VVPAT and they complied... Where is the direction of the court to match all slips? The court later said 5% (EVM-VVPAT matching in 2019) and they have followed our order. Let someone from those 5% say there have been mismatches. Can we issue a mandamus on the basis of suspicion?” the bench asked.

It pointed out that the top court had intervened on two occasions in the past. “At the first instance, this court asked them (ECI) to use VVPAT, and then the verification of EVMs with VVPAT was increased from 1 to 5 [in every assembly segment]. When we asked you (petitioners) for suggestions, we were told to go back to the ballot system...We will see what is needed to strengthen the current system,” the court said.

“If you are already determined about it, we can’t help it. We aren’t here to change your thought process... There has been no hacking detected till date. The report you are relying on says that there is no incident of hacking yet,” the bench told advocate Prashant Bhushan, who appeared for non-profit Association for Democratic Reforms (ADR).

According to Bhushan, the micro-controllers in EVMs contain a flash memory, and therefore are amenable to reprogramming or malicious malware.

Bhushan’s “doubts” over the security of EVMs came through after the court heard a senior ECI official who was called upon to address specific queries regarding the micro-controllers and other security features embedded in the voting machines.

My  Take :

Dear Hon Judges :

In the matter of 100 % verification of VVPAT with EVM , it is quite understandable that you said > We cannot order the Election Commission

But surely, you can “ Ask – Guide – Direct “ the Commission , as you have done many times in the past

Especially , if your “ Guidance “ :

Ø  Will satisfy the demand for 100 % verification

And simultaneously ,

Ø  Eliminate “ Human Intervention “ ( no manual verification what-so-ever ) , altogether !

Dear Hon Judges,

I urge you to “ Ask “ Election Commission :

“ Tell us why you cannot implement the following TECHNOLOGY based solutions ? “ :

VVPAT ? How about EVBAT ?   …………. …………..28 Mar 2019

100 % verification of VVPAT ? No problem ! .. 02 Apr 2019

      Votes Audit : Paper gives 99.9936% / Electronic gives 100 %.. 18 Mar 2024

And also ask Shri Prashant Bhushan :

“ If you have any problems with the implementation of these solutions , within a week tell us what “

Avatar Sir , I have a question

( aka Dronacharya V 2.0 )

Thousands of years ago, SC / ST class Eklavya approached Guru Dronacharya to

 teach him archery

Dronacharya turned him down saying he taught only sons of kings

Disappointed Eklavya returned to his jungle cottage but instead of feeling

disheartened, he sculpted a statue of the Guru in dry grass , installed it on a

pedestal , bowed in reverence and started shooting arrows at distant

targets

He repeated this exercise day long, for years on end, till he mastered archery

even better than those sons of Kings

5,000 years after the Mahabharat , this drama could have a redux in the form of

my Virtual Avatar

www.HemenParekh.ai

Approx. 13 lakh schools are located in our 6.64 lakh villages – many without a

single teacher and some with just 1 or 2 teachers

Even in those having a couple of teachers, the quality of teaching is miserably

outdated

In the absence of PHYSICAL and COMPETENT teachers, can TECHNOLOGY fill the

vacuum ?

I think so ( - provided , the new government at the Centre has a will to help the

underprivileged village children )

Here is how :

Under government’s BharatNet project , as of today, some 200,000 gram-

panchayats ( out of targeted 250,000 ), have been connected to internet via

Optical Fibre Cable ( OFC )

This OFC provides a bandwidth of 100 mbps ( pretty good )

Let govt provide FREE Smart phones or Tablets, to the students of these schools (

by no means a FREEBIE ,nor included in BJP’s Sankalp Patra ).

Include this item in 100 DAYS ROAD-MAP

Then these children will ask www.HemenParekh.ai ( Dronacharya 2.0 ) following (

sample for illustration ) questions ( in local language ) and get correct replies (

better than those highly paid / competent teachers of elite city schools )

I have taken only 5 questions from PHYSICS syllabus of 10th standard but it could

be 50 questions for ANY subject and for ANY standard ( from 1st to 10th ) . I have

not tried questions for college degrees in ANY discipline

And the ICING on the CAKE is :

Students can “ ask “ questions by simply “ talking “ ( in chosen language ) and

get to “ listen “ to the answers !

And they can enjoy this “ teaching “ by their VIRTUAL TEACHER, whether in school

or at home.

Question

Answer from my Avatar

State the laws of reflection of light

When light reflects off a surface, it follows two important laws: the angle of incidence is equal to the angle of reflection, and the incident ray, reflected ray, and normal to the surface all lie in the same plane.

A car accelerates from rest at a rate of 5 m/s². If it reaches a speed of 20 m/s in 4 seconds, calculate the distance traveled by the car in those 4 seconds.

The distance traveled by the car can be calculated using the formula: distance = (initial velocity * time) + (0.5 * acceleration * time^2). Plugging in the values, we get: distance = (0 * 4) + (0.5 * 5 * 4^2), which simplifies to: distance = (0) + (0.5 * 5 *16), and finally gives us: distance = 40 meters.

Define electric current. List two factors on which the resistance of a wire depends.

Electric current is the flow of electric charge through a conductor. It is measured in amperes (A). The resistance of a wire depends on its length and cross-sectional area. The longer the wire, the higher the resistance, and the smaller the cross-sectional area, the higher the resistance.

Explain how an electromagnet works. Describe one application of electromagnets in our daily lives.

Electromagnets work by creating a magnetic field when an electric current flows through a coiled wire. This magnetic field can attract or repel other objects, depending on the polarity. One common application of electromagnets in our daily lives is in electric doorbells, where the chime is attracted to the magnet when the circuit is completed.

Differentiate between potential energy and kinetic energy. Give an example of each type of energy.

Potential energy is the stored energy an object has because of its position or state, such as a ball held above the ground. Kinetic energy is the energy possessed by a moving object, like a car in motion. Do you have any other questions about different types of energies?

Question

Answer

State the laws of reflection of light

A car accelerates from rest at a rate of 5 m/s². If it reaches a speed of 20 m/s in 4 seconds, calculate the distance traveled by the car in those 4 seconds.

Define electric current. List two factors on which the resistance of a wire depends.

Explain how an electromagnet works. Describe one application of electromagnets in our daily lives.

Differentiate between potential energy and kinetic energy. Give an example of each type of energy.

Electoral Bonds: Transparency in Political Funding

[Article link]

(https://www.hindustantimes.com/india-news/electoral-bonds-will-be-back-after-consultations-nirmala-101713551585909.html#:~:text=The%20Bharatiya%20Janata%20Party%20(BJP,controversial%20political%20funding%20scheme%20that)

Extract from the Article:

The Bharatiya Janata Party (BJP) intends to bring back electoral bonds in some form after wide consultations with stakeholders if it is re-elected in the 2024 general elections, Union finance minister Nirmala Sitharaman said on Friday. Sitharaman emphasized the importance of transparency and the need to prevent black money from entering the political funding system.

Extract from the Blogs I've Previously Written:

In a blog post from March 2024, I discussed Finance Minister Nirmala Sitharaman's decision to decline the offer to contest in the Lok Sabha elections due to a lack of funds. This aligns with the current conversation around electoral bonds and the financial challenges faced by politicians in the election process. Another blog post from October 2017 explores the concerns around the Electoral Bond Scheme and the need for transparency in political funding.

My Take:

The reintroduction of electoral bonds, if done after thorough consultations and reforms, could potentially enhance transparency in political funding. It is essential to address the loopholes that allow for anonymous donations and potential misuse of funds. My suggestion for a Central Election Fund, as outlined in previous blog posts, could provide a structured and transparent mechanism for political parties to receive funding.

The current system of political funding requires a significant overhaul to ensure fairness and accountability. By moving towards a more regulated and transparent model, we can restore trust in the electoral process. It is crucial for all stakeholders, including the government, political parties, donors, and the Election Commission, to work together to create a system that upholds democratic values and prevents corruption.

Comments:

The issue of electoral bonds and political funding continues to be a topic of debate and concern among citizens. It is imperative for the government to address these issues effectively to uphold the integrity of the democratic process.

Call to Action:

As citizens, we must stay informed about electoral reforms and advocate for transparent and accountable political funding mechanisms. Engaging with policymakers and supporting initiatives that promote fairness in elections can contribute to a healthier democracy.
