Enforcing  is  difficult  ?



A few days back , Shri B N Srikrishna ( of committee for drafting “ DATA PROTECTION LAW “ ) . said :
“ Drafting a Data Protection Law is not so difficult but enforcing it will be very difficult  



Why ?




First reason :


Courts will find it extremely difficult ( if not impossible ) to “ interpret “ correctly , the “ intended meaning “ of the following terms / words , likely to be used in that law :


#   Private

#   Data

#   App

#   Permission

#   Access

#   Download

#   Sign

#   Rights

#   Own

#   Personal

#   Share

#   Entity

#   Processing

#   Obligation

#   Handling

#   Collection

#   Use








Second Reason :


Technology for collecting / compiling, personal / private data of unsuspecting citizens through use of AI is expanding by the hour !


After looking at the following announcements in the past few months , I wonder if the proposed law will become “ obsolete “ by the time President signs it :

I have a lurking suspicion that enforcing any DATA  PROTECTION  LAW is more likely to be impossible than merely difficult  !



With millions of manufacturers ( located all over the world and beyond Indian jurisdiction  ) of  ,


IoT DEVICES  /  MOBILE TELEPHONE SERVICES  /  INTERNET  SERVICES  /  MOBILE  APPS  /  OPERATING  SYSTEMS  /  E COMMERCE  PORTALS  /  ONLINE  HEALTHCARE  SERVICES  /  FINTECH  SERVICES  /  MOBILE WALLETS  /  ONLINE  BANKING  /  CREDIT-DEBIT  CARDS  /  ATMS ,,,,etc etc ,


- who will you catch ( for alleged breaking of Data Protection Law ) , how will you prove guilt and how long might that take ?



And remember , every law that everyone gets obliged to break , on almost daily basis , and whose enforcement is impossible , gives rise to massive corruption by a tribe called “ Law Enforcement Agencies “ 


Like paying haftas for everything you do to survive !

Idea for Self Employment ?

May be , one day soon , some Start Up will launch an agency which will supply “ People Walkers “ to India’s lonely ( have to be rich enough to afford )

Just the kind of agencies which supply daytime / night-time nurses , for ( ? ) Rs 500 per night ( approx. Rs 60 per hour )

Currency Notes for Visually impaired ?





Today’s Business Line carries following news :






Solutions being considered :


*   Notes should be of different sizes


*   Notes should have embossed symbols for easy identification ( like braille )


*   RBI to look into the feasibility of developing a device or mechanism to help the
     visually challenged easily identify currency notes


The first two solutions are fairly simple and straightforward



But , both will require scrapping the current notes and re-printing with accepted solution



Persons opposed to “ device or mechanism “ solution say :


A very expensive proposal for a small minority


And , this solution too , may require re-printing  !




But , if the present notes have to be scrapped in any case and new ones have to be printed , I suggest following solutions which have a desirable “ bye-product “ of eliminating / reducing BLACK MONEY as well !



SECURITY  THREAD :


*  The  metallic SECURITY THREAD in the Currency Notes can be made to store the
   unique SERIAL NUMBER of each currency note , AND a simple Smart Phone can read
   that number and transmit that data to any government agency ( IT / ED / CVC etc )


   This will be coupled with a Mobile App which will   SPEAK ALOUD  the denomination of
   a note held near the currency note, using NFC / BLUE TOOTH

This is a completely electronic-free design , which means you can iron the smart fabric or put it in the washer and dryer. We are using something that already exists on a smart phone and uses almost no power, so the cost of reading this type of data is negligible


The team also demonstrated that the magnetized fabric could be used to interact with a smart phone while it is in one’s pocket


Scientists realized that this off-the-shelf conductive thread also has the magnetic properties that can be manipulated to store either digital data or visual information like LETTERS or NUMBERS





I believe all currency notes come with a metallic SECURITY THREAD , capable of being magnetized



So, could that thread be able to store the UNIQUE SERIAL NUMBER , assigned to each and every currency note , which , in turn , can be “ read “ by the Smart phone , and “ transmitted “ to the Central Server of the India’s Income Tax Department ?



If possible , this can track those high denomination currency notes lying in wallets / purses ( - assuming that a smart phone is also next to those notes )

Water Wars Are Looming !


Not  Funny  :  Just  Sad  !



More than a year back , I sent following blog as email to our Cabinet Ministers and Shri Devendra Fadnavisji



Water Water Everywhere ? Even in Latur ?  [  15  April 2017  ]




In my email , I had urged our Policy Makers to get in touch with Prof Yaghi ( University of Berkeley -  yaghi@berkeley.edu / oyaghi@lbl.gov / Ph : 510-643-5507 ) , for acquiring his technology to extract water from dry desert atmosphere , using ONLY SUNLIGHT  !

No need for any electricity !

I followed this up with following e mails :



None of these seem to have been read !

Since then , Prof Yaghi and his team have made further progress to establish commercial viability of this life-saving technology , as reported in :




I am sure , our own scientists are quite capable of developing such a technology but should we wait when “ WATER WARS “ in India are unlikely to remain confined to one State against another State ?

If we fail to find / implement – and on the double – a very cheap and practical way to produce water from air , we are headed for “ WATER WARS “ between ,

*  Different regions within each State

*  Different cities within each Region

I hope this email will get read and acted upon

Making best of a bad bargain ?




I will repeat what I have been saying for the past couple of years


Protecting your own personal / private data from being used by all sorts of businesses for making money, is getting impossible


So , why not “ sell “ it yourself and , in the process , make some money  ?


Cut out the middleman !


Of course , such a “ new rule of the game “ , will require some sensible DATA PROTECTION LAW which goes beyond mere “ protection “ and enables “ empowerment “


I believe , GDPR . launched in EU on 25th May , may somewhat protect such “ Unauthorised Mis-use “ of a person’s data but it fails to “ empower “ that person to permit “ Authorised Re-use “ of his data by third parties , and in the process , make money for himself  !


To overcome this ( lack of empowerment ) , I proposed :

That could mean selling it, granting limited use in exchange for a service (like Facebook), or simply keeping it private. The point is to have control.

Sundar Pichai’s  seven  “Principles of AI “  ?




We have all heard of Isaac Asimov’s three  Laws of Robotics



Now comes Google CEO , Sundar’s seven “ Principles of AI “ ( I suppose, Sundar will want to wait for these to become LAWS  )






These are :

1.   Socially Beneficial

2.   Avoid Discrimination and Bias

3.   Safety Checks

4.   Accountability

5.   Incorporation of Privacy Design Principles

6.   High Standards of Scientific Excellence

7.   Checking Abusive Application

     Google will check the abusive application of AI by carefully assessing the purpose of a

     technology, uniqueness and accessibility, the scale of impact and the nature of the

     company’s involvement in a project.


 

This announcement on part of Google , is indeed , a good beginning



I do hope that , in course of time , Google will expand this list to add :
