I sent to you [ - and to each member of your committee ], following email yesterday :


-      where , I made a few suggestions on regulating / reducing , online pornographic content

This morning, I came across following news report :

 

Rajya Sabha panel lays out child porn crackdown plan


Here are the highlights of the recommendations as reported in this news :


Ø  Creation of a regulatory framework to curtail the access of pornographic material to childrenincluding the creation of a new regulator, a more dedicated regulatory framework.


Ø  The government has to significantly improve their enforcement of existing laws


Ø  India must take a leadership role and constitute an international alliance against child porn in the lines of a solar alliance.


Ø  Creating an organization like Interpol to exclusively tackle child pornography


Ø  Focus on three areas — technology, administrative steps, and legal measures — to find a solution.

     { advancement in technology makes it difficult to stop pornographic material on the
      Internet }


Ø  China has put a blanket ban on Google and WhastApp, but the panel was clear that China model should not be followed in India

I understand that your Committee will submit its report to the Government on 15 Jan


     Without doubt, your committee will debate – and decide the priorities based on the
     following considerations :


Ø  What is “ Important – but not quite Urgent

     ( eg : International Alliance / Interpol like organization )



Ø  What is both “ Urgent AND Important

( eg : Improving enforcement of existing laws /  Dedicated  Regulatory Framework )



Members of your committee are right in saying :


“ As far as regulation of internet is concerned, we need not blindly follow, either the Chinese model or the Russian model “



But the model suggested by me is superior to those , in the following respects :



Ø  It is “ Voluntary “ and not “ mandatory “


Ø  It does not invade the “ Privacy “ of the users



Ø  It will refuse “Registration “by a person who is not an adult !


Ø  It will enable users to “monetize “ their personal data  - if they wish

Time to Get Impatient ?

Ø  Platforms like WhatsApp and Signal do not cooperate with law enforcement agencies citing end-to-end encryption and don't even honour lawful requisitions, government officials have told a Rajya Sabha panel looking into the issue of pornography on social media and its effects on children.

Ø  Earlier this month, an ad-hoc committee of the Rajya Sabha was formed by the Upper House Chairman M. Venkaiah Naidu on the "alarming issue" of pornography on social media and its effects on children and society as a whole

Ø  Appearing before the panel, MEITY in a note said the ministry faces many legal challenges from social media platforms on the issue of pornography as their servers are abroad and they "claim to be governed by laws of hosting country when information for investigation is sought".

Ø  While in some cases, the ministry said, only meta data is shared and for majority cases either mutual legal assistance treaty or letter rogatory is insisted upon which is a very time-consuming process.

Ø  Even lawful requisitions are not honoured," the ministry said in the note shared with panel members.
Ø  It further said the law enforcement officials do not have explicit powers for undercover operations………

Present legal status of pornography in India , as reported in Wikipedia , is :


·         In July 2015 the Supreme Court of India refused to allow the blocking of pornographic websites and said that watching pornography indoors in the privacy of one's own home was not a crime


·          In February 2016 the Supreme Court asked the Indian Government to suggest ways of banning all forms of child pornography.[15]


·         In October 2018 the government directed Internet service providers to block 827 websites that host pornographic content following an order by the Uttarakhand High Court

A Reform by Re-naming ?




Just came across following news report :



Extract :

 “In the absence of any legislative framework, the NSC has faced challenges in implementing its recommendations,” the government said inviting comments on the proposed law.


It tasks the NCS with a mandate “to evolve, monitor and enforce statistical priorities and standards and to ensure statistical coordination” and gives it a corporate structure.


The Bill envisages financial autonomy for the commission through an independent National Statistical Fund, but it would be bound by directions that the Centre “may give in writing to it from time to time”

This is a long-overdue, welcome step


[ A ]

The most important feature is : “ Corporate Structure


This means the government must treat the proposed “ National Statistical Fund “ as a one-time infusion of EQUITY, in this “ CORPORATION


Then ask its directors to generate income / profit from its OPERATIONS ( year after year ).


In short , tell the Board of Directors :


Ø   NSC is not a PSU

Ø   You will register with ROC as a “ Company “ , but you will be independent as

      Election Commission , reporting to the President of India  

Ø  You will generate your own INCOME from which , you will meet all your EXPENSES . This may include selling of statistical data ,as per existing policy of the government , as illustrated in :

          Bulk Data Sharing / Selling Policy ?

Ø   If you need to , you will raise further equity from the open market ( by IPO listing )


Ø   You can take loans from banks, strictly on prevailing commercial terms

Ø   Government will not offer any sovereign guarantee for such loans


Ø   You will launch your web site where you will upload every quarter, working results

Ø   On this web site, you will also publish, METHODOLOGIES for compilation of statistics

Ø  Besides methodologies / statistical techniques employed ( for each type of statistics ), you will also publish on your web site :

#  Broad synopsis / summary / findings , for each type of statistics

#  Sale price for each statistical data compiled ( - indicating period cove
red )

#  Format in which the data will be supplied ( when purchased online )

#  Purchase Cart

Another important feature is : “ Statistical Priorities “ and “ Statistical Coordination


The task entrusted to NSC is mind-boggling , given that India is a huge country of 1.37 billion people


And there is ambiguity whether “ Compilation of Statistics “ is a “ Central Subject “ , a “ State Subject “ or a “ Joint Subject “

  
The proposed law must clearly bring out , “ whose responsibility is what “ , and how are States and Govt Agencies, expected / required to “Coordinate “ with the NSC


Since NSC must act as a “ Profit making Company “ , it will need to have , as few permanent employees on its payroll , as possible


Therefore, it becomes essential that NSC develops / launches, a TECHNOLOGY PLATFORM which will enable it to compile various types of statistics , automatically and on-going basis , with as little “ human intervention “ as possible


That means :

 
Ø  No conducting of SURVEYS , using door-to-door enumerators

Ø  Using different MOBILE APPS for different surveys


Ø  Automatic compilation / display of Survey Results on NSC web site
