Lawyers blame ChatGPT for tricking them into citing bogus case law      ……………. Hindu  / 09 June 2023

Extract :

Two apologetic lawyers responding to an angry judge blamed ChatGPT Thursday for tricking them into including fictitious legal research in a court filing.

Attorneys Steven A. Schwartz and Peter LoDuca are facing possible punishment over a filing in a lawsuit against an airline that included references to past court cases that Schwartz thought were real, but were actually invented by the artificial intelligence-powered chatbot.

The chatbot, which has fascinated the world with its production of essay-like answers to prompts from users, suggested several cases involving aviation mishaps that Schwartz hadn't been able to find through usual methods used at his law firm.

The problem was, several of those cases weren't real or involved airlines that didn’t exist.

“I did not comprehend that ChatGPT could fabricate cases,” Schwartz said.

“Can we agree that's legal gibberish?” Castel asked.

I would like to sincerely apologise,” Schwartz said.

He added that he had suffered personally and professionally as a result of the blunder and felt “embarrassed, humiliated and extremely remorseful.”

He said the case demonstrated how the lawyers might not have understood how ChatGPT works because it tends to hallucinate, talking about fictional things in a manner that sounds realistic but is not.

“It highlights the dangers of using promising AI technologies without knowing the risks,” Shin said.

My  Take  :

Dear Sam,

During your talk with Satyen Gajwani ( Times Internet ) in Delhi on 07th June, someone asked you about the possibility of some Indian Company , committing itself to develop  / launch its own AGI , on par with ChatGPT

You said ( something to that effect ) : Why re-invent the wheel ? Focus on developing the spokes

Yesterday’s news indicated that some Indian Companies are seriously considering developing their own AGI

Only time will tell whether this was a right way to commit their resources

But I think Indian Companies should focus on development of the following “ spokes “ , for immediate benefit of millions of Indian citizen ( using Training Data, which are strictly confined to data of Indian Citizen )

OpenAI, maker of ChatGPT, hit with proposed class action lawsuit alleging it stole people’s data  /  CNN / 28 June 2023

Extract :

OpenAI, the company behind the viral ChatGPT tool, has been hit with a lawsuit alleging the company stole and misappropriated vast swaths of peoples’ data from the internet to train its AI tools.

The proposed class action lawsuit, filed Wednesday in a California federal court, claims that OpenAI secretly scraped “massive amounts of personal data from the internet,” according to the complaint.

The nearly 160-page complaint alleges that this personal data, including essentially every piece of data exchanged on the internet it could take,” was also seized by the company without notice, consent or “just compensation.”

Moreover, this data scraping occurred at an “unprecedented scale,” the suit claims.

OpenAI did not immediately respond to CNN’s request for comment Wednesday. Microsoft, a major investor into OpenAI, was also named as a defendant in the suit and did not immediately respond to a request for comment.

“By collecting previously obscure personal data of millions and misappropriating it to develop a volatile, untested technology, OpenAI put everyone in a zone of risk that is incalculable – but unacceptable by any measure of responsible data protection and use,” Timothy K. Giordano, a partner at Clarkson, the law firm behind the suit, said in a statement to CNN Wednesday.

The complaint also claims that OpenAI products “use stolen private information, including personally identifiable information, from hundreds of millions of internet users, including children of all ages, without their informed consent or knowledge.”

Uncensored Chatbots Provoke a Fracas Over Free Speech  ( nytimes / 02 July )

Extract :

A new generation of chatbots doesn’t have many of the guardrails put in place by companies like Google and OpenAI, presenting new possibilities — and risks.

A.I. chatbots have lied about notable figures, pushed partisan messagesspewed misinformation or even advised users on how to commit suicide.

To mitigate the tools’ most obvious dangers, companies like Google and OpenAI have carefully added controls that limit what the tools can say.

Now a new wave of chatbots, developed far from the epicenter of the A.I. boom, are coming online without many of those guardrails — setting off a polarizing free-speech debate over whether chatbots should be moderated, and who should decide.

“This is about ownership and control,” Eric Hartford, a developer behind WizardLM - Uncensored, an unmoderated chatbot, wrote in a blog post. “If I ask my model a question, I want an answer, I do not want it arguing with me.”

Several uncensored and loosely moderated chatbots have sprung to life in recent months under names like  GPT4All  and  FreedomGPT.

Many were created for little or no money by independent programmers or teams of volunteers, who successfully replicated the methods first described by A.I. researchers.

Only a few groups made their models from the ground up. Most groups work from existing language models, only adding extra instructions to tweak how the technology responds to prompts.

The uncensored chatbots offer tantalizing new possibilities.

Users can download an unrestricted chatbot on their own computers, using it without the watchful eye of Big Tech.

They could then train it on private messages, personal emails or secret documents without risking a privacy breach.

Volunteer programmers can develop clever new add-ons, moving faster — and perhaps more haphazardly — than larger companies dare.

But the risks appear just as numerous — and some say they present dangers that must be addressed. Misinformation watchdogs, already wary of how mainstream chatbots can spew falsehoods, have raised alarms about how unmoderated chatbots will supercharge the threat. These models could produce descriptions of child pornography, hateful screeds or false content, experts warned.

Google has been testing its medical AI chatbot, Med-PaLM 2, in hospitals, including the Mayo Clinic research hospital.

According to a report by WSJ, the AI chatbot was being tested since April. Med-PaLM 2 is an AI tool designed to provide answers to medical questions

It is an updated version of PaLM 2, which was announced at Google I/O in May.

The chatbot is trained on a curated set of medical expert demonstrations to improve its healthcare conversation capabilities.

The report cites an internal mail saying Google's Med-PaLM 2 can be particularly helpful in countries with limited access to doctors.

However, there are some accuracy issues with the chatbot, as highlighted in a research paper published by Google in May.

Physicians found more inaccuracies and irrelevant information in the answers provided by Med-PaLM 2 compared to those provided by other doctors.

Kauravas configured their army in the form of a “ Chakra-vyuha “

Pandav warrior Abhimanyu had learned the art of “ Entering / penetrating “ a “ Chakra-vyuha “

Govt Urges Online Platforms To Refrain From Adopting Dark Patterns Harming Consumer Interest

Extract :

The Department of Consumer Affairs, Government of India has urged online platforms to refrain from incorporating any design or pattern in the online interface of their platform that may deceive or manipulate consumer choice and fall in the category of dark patterns.

In a letter addressed to major online platforms in India, Shri Rohit Kumar Singh, Secretary, Department of Consumer Affairs has strongly advised online platform to not engage in ‘unfair trade practices’ by incorporating dark patterns in their online interface to manipulate consumer choice and violate ‘consumer rights’ as enshrined under Section 2(9) of the Consumer Protection Act, 2019.

It is pertinent to note that dark patterns involve using a design and choice architecture to trick, coerce or influence consumers to make choices not in their best interest.

Engaging in such deceptive and manipulative conduct by using dark patterns in online interfaces unfairly exploits consumers’ interest and constitutes ‘unfair trade practice’ under the Consumer Protection Act, 2019.

Recently, regulators in other jurisdictions such as European Union, USA and UK have taken action against dark patterns involving unfair and deceptive practices in online interfaces which were found to be detrimental to consumers.

The activities which the platforms were observed to be indulging include:-

  • Non-consensual enrolment in subscription programs (USA)
  • Pressure selling using misleading countdown clock (UK)
  • Secretly saving credit card information and charging users without consent (USA)
  • Putting in place a cancellation process designed to deter consumers from opting out of subscription (Norway).

Some examples of Dark Patterns are:

  • False Urgency:

This tactic creates a sense of urgency or scarcity to pressure consumers into making a purchase or taking an action.

  • Basket Sneaking:

Websites or apps use dark patterns to add additional products or services to the shopping cart without user consent.

  • Subscription Traps:

This tactic makes it easy for consumers to sign up for a service but difficult for them to cancel it, often by hiding the cancellation option or requiring multiple steps.

  • Confirm Shaming: I

It involves guilt as a way to make consumers adhere. It criticizes or attack consumers for not conforming to a particular belief or viewpoint.

  • Forced Action:

This involves forcing consumers into taking an action they may not want to take, such as signing up for a service in order to access content.

  • Nagging:

It refers to persistent, repetitive and annoyingly constant criticism, complaints, requests for action.

  • Interface Interference:

This tactic involves making it difficult for consumers to take certain actions, such as canceling a subscription or deleting an account.

  • Bait and Switch:

This involves advertising one product or service but delivering another, often of lower quality.

  • Hidden Costs:

This tactic involves hiding additional costs from consumers until they are already committed to making a purchase.

  • Disguised Ads:

Disguised ads are advertisements that are designed to look like other types of content, such as news articles or user-generated content.

Two days back ,I sent following e mail to Shri Rajan Anandan of Google

[  'ranandan@google.com'  /  'rajan@google.com'   /  @RajanAnandan   ]

Dear  Rajan,

Does following  appear  doable  ?

Google Ads - Coming Soon to Billboard Near You ?       https://lnkd.in/fQn8w46

But Ads , either on our TV screens or on a Billboard, are STATIC

It is only a matter of time before Google starts displaying on the sides of city transport buses , DYNAMIC and CONTEXTUAL advts !

This concept has immense possibilities in a country like India where thousands of pedestrians are all the time walking on roads

Say , a spectacle-wearing pedestrian is standing on the footpath , in front of a shop of SUNAYAN OPTICIANS and sees a BEST bus approaching .

He had visited an eye doctor in the morning ( record on Mobile )

Lo and behold ! He sees on the side of the bus , an ADVT from SUNAYAN OPTICIANS , saying : FREE eye check up for the next 15 minutes !

That advt turns into an ad from AJANTA CHEMIST ( located 50 feet away down the road ) , where a pedestrian has a mobile in his hand , using which , he had ordered PENTOCID tablets in the morning

To his amazement , he notices that the Google Ad urges him to buy ANTACID tablets at 20 % discount - of course, from AJANTA CHEMIST !

But this required both those guys to be “ watching “ those ads on the sides of a moving bus

Now , if you are wondering :

How Google will manage to deliver Ads to you if you are sleeping with your eyes closed , no need to wonder

Google is developing devices ( Smart phones / Smart watches / Wrist bands / Google Assistant and even contact lenses with Augmented Reality / Virtual Reality / Brain Computer Interfaces and a hundred other IoT devices surrounding you 24x7  ) , all of which will deliverthose Ads to your brain where these Ads will appear like Dreams “ !

Who knows , these “ dreams “ might one day , even deliver “ solutions “ to your problems ( no need to “ search “ for solutions in Google Search bar !

Millions may not care what Google knows about them ( - and how it got to know all about them ) , if Google can make their lives “ less miserable / less struggle / more convenient / more comfortable / more happy “

For them , it could well be :  Privacy ko maro Goli

Norway regulator to fine Meta over privacy breaches

Extract :

Facebook and Instagram owner Meta Platforms will be fined one million crowns ($100,000) per day over privacy breaches unless it takes remedial action, Norway’s data protection authority said on Monday, in a move that could have wider European implications.

Regulator Datatilsynet said it would charge the fine every day from Aug. 4 until Nov. 3 unless Meta takes action.

It said Meta cannot harvest user data in Norway, such as users’ physical locations, and use it to target advertising at them, called behavioural advertising, a business model common to Big Tech.
