Menstruation Checks: A Privacy Violation

The recent news that a bar body has petitioned the Supreme Court to frame guidelines against intrusive 'menstruation checks' for women workers has truly struck a chord with me. The very idea that such personal and private bodily functions could be subject to verification, especially in a professional setting, is deeply disturbing. It speaks to a fundamental disrespect for individual dignity and privacy, a theme I have explored often in my writings.

I remember vividly the Supreme Court's profound deliberations on the Right to Privacy in 2017. Justice Chandrachud, in particular, raised critical questions about how we define privacy in an age where social media and technology constantly blur its boundaries. Senior advocate Shyam Divan powerfully argued for 'informational self-determination,' emphasizing an individual's right to control what personal data they share. Former solicitor general Gopal Subramanium eloquently linked privacy to liberty and dignity, stating that it encompasses the right to make personal choices and develop one's personality Right to Privacy ! Thank You Your Honors !. These discussions were not just academic; they were about the very essence of what it means to be a free individual.

It is truly shocking, as the Supreme Court itself reportedly observed, that such a mindset persists. While my previous blogs often focused on the subtle, insidious erosion of privacy by technology — devices that 'listen to and analyze conversations' or track our every move, as I discussed concerning Amazon's Bee AI wristband Jeff Bezos May Save Mankind — this issue of 'menstruation checks' highlights a much more crude, yet equally invasive, assault on personal space and dignity.

In 2017, I pondered whether 'technology will dispose' of the privacy safeguards that the Supreme Court might 'propose' Supreme may Propose : Technology will Dispose. I wrote about how everything about us, from our health data to our daily habits, is increasingly 'captured and shared,' often without our explicit permission Privacy does not live here !. These 'menstruation checks' are a stark reminder that the battle for privacy is not solely a digital one. It is also a deeply personal fight against archaic and demeaning practices that seek to control and scrutinize individual bodies.

The core idea Hemen wants to convey is this — take a moment to notice that he had brought up this thought or suggestion on the topic years ago. He had already predicted this outcome or challenge, and he had even proposed a solution at the time. Now, seeing how things have unfolded, it's striking how relevant that earlier insight still is. Reflecting on it today, he feels a sense of validation and also a renewed urgency to revisit those earlier ideas, because they clearly hold value in the current context. The principles of dignity and bodily autonomy are non-negotiable, whether facing technological surveillance or physical inspection.
